TERMS AND CONDITIONS OF SALE

SARL GPH - Hôtel Duminy Vendome is a limited liability company with a capital of €13,496,000, registered in the Paris Trade and Companies Register under number 498 071 638, with its registered office at 3/5 rue du Mont-Thabor, 75001 PARIS - France, and with an intra-Community VAT number FR57 498 071 638.

These terms and conditions (hereinafter referred to as the "Terms and Conditions") govern the relationship between the customer (hereinafter referred to as the "Customer") and SARL GPH - Hôtel Duminy Vendome, the company operating the hotel (hereinafter referred to as the "Hotel Duminy Vendome" or the "Provider") for which the Customer makes a reservation on the website: https://www. hotelduminyvendome.com/ (hereinafter referred to as "the Website"), on a site that has entered into a service or partnership agreement with Hôtel Duminy Vendome (hereinafter referred to as "the Partners"), by e-mail, by telephone, or directly on site, and whose names and contact details appear below and in the reservation summary.

1. Preamble and scope of application

These General Terms and Conditions of Sale apply, without restriction or reservation, to all purchases of hotel room reservation services and related services (hereinafter "the Services") offered by the Hotel Duminy Vendome to consumers and non-professional customers ("the Customer"). The main characteristics of the Services are presented on the Website. It is the Customer's responsibility to read them before making any reservation. The choice and purchase of a Service is the sole responsibility of the Customer.

The Customer declares :

    • He/she has full legal capacity to commit himself/herself into the present Terms and Conditions.
    • He/she is reserving hotel rooms and related services for his/her own personal use.
    • Be able to save and/or print the present General Sales Conditions.

These conditions apply to the exclusion of all other conditions, in particular those applicable to other sales channels for Services.

The Customer is hereby informed that the Hotel Duminy Vendome has entered into partnership agreements with third-party travel service providers in order to enable the Customer to search for, select and reserve rooms in the Hotel Duminy Vendome by using the services offered by these Partners on their website. Any reservation of hotel rooms made under these conditions implies that the Customer has read and fully accepted, without reservation, the special conditions of the Partners, the conditions of sale of the reserved rate and these General Terms and Conditions of Sale. The Customer declares that he/she has obtained all necessary information from the Hotel Duminy Vendome, which is available on the website.

The present General Terms and Conditions of Sale are accessible at all times on the Hotel Duminy Vendome website and shall prevail, where applicable, over any other version or any other contradictory document.

In the absence of proof to the contrary, the data recorded in the service provider's computer system constitutes proof of all transactions concluded with the Customer. Thus, the entry of banking information, the acceptance of the General Terms and Conditions of Sale, the conditions of sale of the rate or the reservation request, has, between the Hotel Duminy Vendome and the Customer, the same value as a handwritten signature on paper. The computerized registers kept in the computer systems of the Hotel Duminy Vendome under reasonable conditions of security are considered as proof of communication, order and payment between the Hotel Duminy Vendome and the Customer. The Hotel Duminy Vendome will keep the written record of the conclusion of the contract in electronic or paper format for a maximum of 3 years. The present General Terms and Conditions of Sale also include the Personal Data Charter.

The Customer declares that he/she has read the present General Terms and Conditions of Sale (including the Personal Data Charter) and has accepted them by choosing to make a reservation. Validation of the reservation of Services by the Customer implies acceptance without restriction or reservation of the present General Terms and Conditions of Sale (including the Privacy Policy). As these General Terms and Conditions of Sale may be subject to subsequent modification, the version applicable to the Customer's purchase is the one in force on the website at the time of the reservation.

The present General Terms and Conditions of Sale are applicable for the duration of the online services offered by the Hotel Duminy Vendome on its Website. Hotel Duminy Vendome reserves the right to temporarily or permanently close access to its Website.

2. Booking process

2.1 BOOKING ONE OR MORE NIGHTS ON THE HOTEL'S WEBSITE, ON A PARTNER WEBSITE, BY TELEPHONE, E-MAIL OR ON SITE

The customer chooses the services he/she wishes to book, as follows:

1.            Selection of dates and number of nights

2.           Selection of room type and rate

3.           Selection of additional services if applicable

4.           Verification and validation of booking details, total booking amount, rate conditions

5.           Indication of contact details

6.           Entry of credit card details in case of guarantee or prepayment.

7.            Consultation and acceptance of the General Terms and Conditions of Sale and of the conditions of the fare selected prior to validate the booking.

8.           Confirmation of booking

The Customer acknowledges that he/she has taken cognizance of the nature, destination and booking terms of the Services offered by the Service Provider and that he/she has requested and obtained the necessary information to make his/her booking with full knowledge of the facts. The Customer is solely responsible for his/her choice of services and their suitability for his/her needs, and Hotel Duminy Vendome cannot be held liable in this respect. The Customer undertakes to complete the information requested on the reservation request and attests to the truthfulness and accuracy of the information transmitted. Contractual information is presented in French and is confirmed at the latest when the reservation is validated by the Customer.

For bookings made exclusively via Internet, a booking is registered on the Service Provider's website when the Customer accepts these General Terms and Conditions of Sale by validating his/her booking. The Customer can check the details of his booking, its total price and to correct any errors before confirming his acceptance (article 1127-2 of the French Civil Code). Confirmation implies acceptance of the present General Sales Conditions in their entirety and constitutes proof of the sales contract.

It is therefore the Customer's responsibility to check the accuracy of the reservation and to report any errors immediately. The sale of Services will only be considered definitive once the Service Provider has sent the Customer confirmation of acceptance of the reservation by e-mail. Any reservation made on the Website constitutes the formation of a contract concluded remotely between the Customer and the Provider. The Hotel Duminy Vendome reserves the right to cancel or refuse any reservation from a Customer with whom there is a dispute relating to the payment of a previous reservation. Except in the case of group bookings, each booking is nominative and may not be transferred to a third party under any circumstances.

2.2 CANCELLATION

2.2.1 Cancellation / Modification of a non-cancellable, non-refundable reservation

In the event of cancellation or modification of a non-cancellable, non-refundable reservation by the Customer, for any reason whatsoever, a sum corresponding to 100% of the total prepaid amount will be automatically acquired by the Service Provider and invoiced to the Customer. The same shall apply in the event of the Customer's failure to arrive on the scheduled arrival date.

2.2.2 Cancellation of a reservation at the Flexible rate

In the event of cancellation of a reservation at the Flexible rate by the Customer after its acceptance by the Hotel at 15:00 (local time) on the day before the planned date of stay, for any reason whatsoever, a sum corresponding to the total amount of the 1st night's stay will be automatically acquired by the Provider and invoiced to the Customer, by way of damages, in compensation for the loss suffered.

2.3 GROUPS

All bookings of 5 rooms or more are considered as groups.

Groups are subject to different rates and special cancellation conditions. For all group bookings, the customer must make a request directly to the reservations department at the following address: book@hotelduminy.com.

Hôtel Duminy Vendome will reply within 72 hours with a price offer and a sales contract detailing the specific conditions.

Hôtel Duminy Vendome is not obliged to respond favorably to a group request, particularly if it considers that it does not have sufficient availability or available personnel to enable the proper implementation of the Services offered.

Excepting the reservation process, cancellation and payment terms, all other sections of the General Terms and Conditions of Sale apply to group reservations.

3. Rates

The Services offered by the Provider are provided at the rates in force on the Website at the time the reservation is recorded by the Provider. Prices are expressed in Euros and include VAT. Prices take into account any discounts granted by the Service Provider under the conditions specified on the Website.

These prices are firm and non-revisable during their period of validity, as indicated on the Website, the Service Provider reserving the right, outside this period of validity, to modify prices at any time.

Rates are indicated before and at the time of booking by the Customer. They are per room for the number of people and the date selected.

Rates are confirmed to the Customer in the Hotel Duminy Vendome's commercial currency and include VAT (excluding tourist tax). They include VAT at the rate applicable on the day of booking; any change in the applicable VAT rate will automatically be reflected in the rates indicated on the date of invoicing. The same will apply to any modification or introduction of new legal or regulatory taxes imposed by the competent authorities.

Rates do not include tourist tax, which can be paid directly to the Hotel Duminy Vendome.

The Customer undertakes to pay these various taxes directly to the Hotel Duminy Vendome.

The payment requested from the Customer corresponds to the total amount of the purchase, except for this Tax.

Unless otherwise stated on the Site, additional services (breakfast, small pet, etc.) are not included in the price.

Conversion into foreign currency is given for information only and is non-contractual. If a rate involves payment directly to the Hotel Duminy Vendome on the Customer's arrival or departure, and the Customer's currency is not the same as that of the Service Provider, the rate debited by the Hotel Duminy Vendome may differ from that communicated at the time of booking, considering changes in the exchange rate between the date of booking and the date of payment.

4. Terms of payment

4.1 PAYMENT OF THE NON-CANCELLABLE, NON-REFUNDABLE PRICE

The price is payable in full, on the day the reservation is confirmed by the customer, in accordance with the terms specified in section: "2. Reservation procedure", by secure payment:

- By credit card: Visa, MasterCard, American Express, Maestro

- By bank transfer

Payment data is exchanged in encrypted mode using SSL protocol. At the time of booking, the customer provides his/her bank details, specifying the name on the credit card, the credit card number, the cryptogram, and the validity date (the credit card must be valid until the end date of the stay). Duminy Vendome will debit the amount equal to the total price of the stay at the time of booking. The customer must present the credit card used to pay the reservation at the Hotel on arrival. The Customer may be asked to show proof of identity to prevent credit card fraud. The Service Provider will not be obliged to provide the Services ordered by the Customer if the price has not been paid in full in accordance with the above conditions. Payments made by the Customer will only be considered final once the amounts due have been received by the Service Provider.

4.2 PAYMENT OF THE FLEXIBLE PRICE

The price is payable in full, on the day of provision of the services reserved under the conditions defined in section: "5. Provision of services", as indicated on the invoice sent to the Customer, by secure payment:

- By credit card: Visa, MasterCard, American Express, Maestro.

- By cash in Euros only

- By bank transfer before arrival date

Payment data is exchanged in encrypted mode using SSL protocol. The hotel reserves the right to temporarily block a maximum amount equal to the total price of the stay (also known as pre-authorization), without this blocking exceeding a total period of 45 days. The Customer will then communicate his bank details, specifying the name of the bank card, the bank card number, the validity date (the bank card must be valid until the end date of the stay) and the cryptogram.

The Customer may be asked to show proof of identity as part of procedures to prevent credit card fraud. The Service Provider will not be obliged to provide the Services ordered by the Customer if the price has not been paid in full in accordance with the above conditions.

Payments made by the Customer will only be considered final once the amounts due have been received by the Service Provider.

5. Provision of Services

5.1 GENERAL INFORMATION

The Customer is hereby informed that, in accordance with legal and/or regulatory provisions, he/she may be required to complete a police form upon arrival at the Hotel Duminy Vendome and to present a valid form of identification.

5.2 USE OF THE ROOM

The Customer undertakes to use the room allocated to him/her and, more generally, all the hotel's facilities in a reasonable manner, in compliance with current regulations, morality and public order.

Unless expressly agreed otherwise, the room will be made available to the Customer at 3 p.m. on the day of arrival, and the Customer will leave the room at 12 a.m. on the day of departure. Failing this, the Customer will be billed for an additional night's stay. Customers must check their departure date. In the event of early departure, a fee equivalent to one night's accommodation will be charged, unless the Customer has notified the Supplier at least 24 hours prior to departure.

The Service Provider undertakes to use its best efforts to provide the Services booked by the Customer, on a best-efforts basis.

5.3 PERSONAL BELONGINGS AND SAFE

The Customer agrees to use the room safe for all valuables.

The Customer is entirely responsible for any personal belongings left in the Hotel Duminy Vendome room, particularly outside the safe or in the Service Provider's public areas. The Hotel Duminy Vendome may not be held responsible for the loss, theft, deterioration, or damage caused to said effects.

5.4 INJURY AND DAMAGE

The Customer is liable to the Hotel Duminy Vendome for any damage caused during the stay, as well as for all direct and/or indirect damage caused by the Customer in the reserved room or in the common areas of the Hotel Duminy Vendome. The Customer will also be held responsible for any objects or furniture belonging to the Service Provider which are missing at the end of the stay.

Consequently, the Customer undertakes to compensate the Hotel Duminy Vendome of the amount of the said damage, without prejudice to any damages and interest that may be due, including legal and court costs incurred by the Hotel Duminy Vendome.

5.5 USE OF CIGARETTES, ELECTRONIC CIGARETTES AND SIMILAR PRODUCTS

The Hotel Duminy Vendome is a non-smoking area.

Consequently, it is strictly forbidden to use cigarettes, electronic cigarettes, or similar products on the premises of the Hotel Duminy Vendome. The customer will be held responsible for any direct and/or indirect damage resulting from smoking on the premises. They will therefore be liable for the full cost of cleaning and restoring the damaged item or area to its original state.

5.6 PETS

Pets are allowed at the Hotel Duminy Vendome (small dogs up to 10kg). You can add them in the supplement section at the time of booking for an additional €10 per night. Guide dogs and assistance dogs are also allowed on the premises, at no extra charge.

5.7 WI-FI USE

When using Wi-Fi Internet access, customers agree to abide by the Terms of Use for Internet access, which will be sent to them when they first connect to the hotel, and which may also be consulted at the reception desk of the Hotel Duminy Vendome.

5.8 DESCRIPTION OF SERVICES

The following services are included in the price of an overnight stay (rates include VAT and are valid only for the dates and number of occupants specified by the customer).

Accommodation in a Single (1pers) / Standard (2pers) / Comfort (2pers) / Superior (2pers) room corresponding to the room type chosen at the time of booking includes the following services:

- Access to DTT channels and a bouquet of international channels. The list of DTT and international channels available is subject to change at any time (according to changes in broadcasters' catalogs) - the list of channels is available in the welcome booklet.

- Free Internet access (Wi-Fi)

- Welcome products (shower gel, shampoo and others on request)

- Secure safe

- Empty minibar

- Use of furniture and bedding

- Bed linen and towels

- Tray with kettle, tea and coffee

- One bottle of mineral water per person, refreshed daily

- Possibility of installing a cot in the room (on request at the time of booking, subject to availability).

For Deluxe and Junior Suite rooms, the following services are included in addition to those listed above:

- Bathrobes and slippers

- Additional hospitality products

All other services or supplies are not included in the price of a night's stay and will be invoiced to the customer in addition, in particular :

- Buffet breakfast (€19 per person per day)

- Drinks at the hotel Bar or Room Service

- Laundry service (price details available in room and at reception)

6. Right of withdrawal

In accordance with article L 221-28 of the French Consumer Code, the Customer does not have the right of withdrawal provided for in article L 221-18 of the French Consumer Code, given the nature of the services provided. The contract is therefore definitively concluded as soon as the reservation is made by the Customer in accordance with the terms and conditions specified in these General Terms and Conditions of Sale.

7. Complaints

The Customer is solely responsible for the choice of services he/she wishes to reserve and their suitability for his/her needs, and Hotel Duminy Vendome shall not be held liable in any way in this respect.

The Customer is informed that the Service Provider is not able to guarantee that the room(s) allocated to him/her will be strictly identical to the photographs of the type of room(s) booked appearing on the website.

Indeed, within the same hotel, variations may exist between different rooms of the same type, particularly in terms of room size, furniture layout, colors, or in the event of furniture changes or renovations. No claims may therefore be made by the Customer unless the differences invoked are substantial.

Any complaints by the Customer must be made to the reception staff of the Hotel Duminy Vendome and, if the Customer considers that no satisfactory solution has been found, must be sent by post or e-mail to the Service Provider, whose contact details are given in the introduction to the General Terms and Conditions of Sale, within a maximum period of thirty (30) days from the end of the Customer's stay.

8. Liability of the Service Provider

The Service Provider guarantees, in accordance with legal provisions and without additional payment, the Customer against any lack of conformity or latent defect arising from a failure to perform the Services reserved and effectively paid for under the conditions and according to the terms defined in these General Terms and Conditions of Sale. The Services provided via the Hotel's website comply with the regulations in force in France. The Service Provider may not be held liable in the event of non-compliance with the legislation of the country in which the Services are provided, which must be verified by the Customer, who is solely responsible for the choice of Services requested.

9. Contingency

The present General Terms and Conditions of Sale expressly exclude the legal regime of unforeseeability provided for in article 1195 of the French Civil Code for all Service operations from the Service Provider to the Customer. The Service Provider and the Customer hereby waive their right to avail themselves of the provisions of Article 1195 of the French Civil Code and the unforeseeable circumstances regime provided for therein, and undertake to assume their obligations even if the contractual balance is upset by circumstances which were unforeseeable at the time the sale was concluded, even if their performance proves excessively onerous, and to bear all the economic and financial consequences thereof.

10. Force majeure and dislocation

The Parties shall not be held liable if the non-performance or delay in performance of any of their obligations as described herein is due to force majeure, as defined in article 1218 of the French Civil Code. In the event of displacement, in particular due to an exceptional event, force majeure or the impossibility of making the reserved room available to the Customer, Hotel Duminy Vendome reserves the right to accommodate the Customer in whole or in part in a Hotel of equivalent category, for services of the same nature and subject to the Customer's prior agreement.

11. Data protection

Pursuant to Law 78-17 of January 6, 1978, amended by Law 2018-498 of June 20, 2018, it is recalled that the personal data requested from the Customer is necessary for the processing of his reservation and the preparation of invoices, particularly. The Customer is informed that his/her IP address is recorded at the time of booking. This data is processed and intended for the Service Provider and may be communicated to any partners entrusted with the execution, processing, management and payment of reservations and the Customer's stay. In addition, Hotel Duminy Vendome may send its customers newsletters, promotional offers and satisfaction surveys by e-mail. In accordance with the provisions of Articles 15 to 21 of Regulation EU 2016/679 of the European Parliament of April 27, 2016 (RGPD), the Customer has a right of access, rectification, deletion, limitation, portability, and opposition.

12. Intellectual property rights

The content of the Website is the property of Hotel Duminy Vendome and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

13. Other provisions

The present General Terms and Conditions of Sale, the Personal Data Charter, the Terms and Conditions of Sale of the fare booked by the Customer, the Booking Request, the Booking Confirmation by the Customer, constitute the entire agreement of the parties within the limits of its purpose. They consequently replace and cancel, within this limit, any prior verbal or written agreement. No tolerance, whatever its nature, scope, duration, or frequency, may be considered as creating any right whatsoever, nor may it limit in any way whatsoever the possibility of invoking each of the clauses of these General Terms and Conditions of Sale. Any clause of the present General Terms and Conditions of Sale which may be declared null and void or illegal by a competent judge shall be rendered ineffective, but its nullity shall not affect the other stipulations, nor the validity of the General Terms and Conditions of Sale as a whole.

14. Law and litigation

14.1 APPLICABLE LAW

These General Terms and Conditions of Sale are drawn up in the French language, without prejudice to any mandatory protective provisions that may be applicable in the consumer's country of residence. Should they be translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute. The present General Terms and Conditions of Sale and the operations arising therefrom are governed by and subject to French law.

14.2 SETTLEMENT OF DISPUTES

The Customer is hereby informed of the possibility of resorting, in the event of a dispute relating to the present General Terms and Conditions of Sale, to a conventional mediation procedure or any other alternative dispute resolution method, under the conditions provided in Article L612-1 of the French Consumer Code.

In the event of a dispute between the professional and the consumer, they will endeavor to find an amicable solution.

If no amicable agreement can be reached, the consumer may refer the matter free of charge to the consumer mediator to which the professional belongs, i.e. the Association of European Mediators (AME CONSO), within one year of the written complaint sent to the professional.

Referral to the Consumer Mediator must be made :

- either by completing the appropriate form on the AME CONSO website: www.mediationconso-ame.com ;

- by post to AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris.

Customers are also informed of the existence of the European platform for Online Dispute Resolution, which they can contact in the event of a dispute by following this link: https://ec.europa.eu/consumers/odr/.

All disputes arising from the purchase and sale transactions concluded in application of these General Terms and Conditions of Sale, concerning their validity, interpretation, execution, termination, consequences, and which cannot be resolved between Hotel Duminy Vendome and the Customer, shall be submitted to the competent courts under the conditions of common law.

15. Pre-contractual information and customer acceptance

The Customer acknowledges that, prior to placing a reservation and entering to a contract, he/she has been provided, in a legible and comprehensible manner, with these General Terms and Conditions of Sale and with all the information listed in article L. 221-5 of the French Consumer Code, and particularly with the following information:

- The essential characteristics of the Services, considering the communication medium used and the Service concerned.

- the price of the Services and related charges.

- in the absence of immediate execution of the contract, the date or deadline by which the Service Provider undertakes to provide the reserved Services.

- information concerning the identity of the Service Provider, its postal, telephone and electronic contact details, and its activities, if not apparent from the context.

- information on legal and contractual warranties and how they apply.

- the functionalities of the digital content and, where applicable, its interoperability.

- the possibility of recourse to conventional mediation in the event of a dispute.

- information on important contractual conditions.

- accepted way of payment.

The fact that a natural person (or legal entity) makes a reservation on the Website implies full acceptance of these General Terms and Conditions of Sale and the obligation to pay for the Services ordered, which is expressly recognized by the Customer, who notably waives the right to invoke any contradictory document, which would be unenforceable against the Service Provider.

The collection of information on persons under the age of 18 is limited to their name, nationality and date of birth, nationality and date of birth, which can only be provided by an adult. 5. What are the purposes?
We collect your personal data in order to : Fulfill our obligations to our customers, manage room reservations and accommodation requests, drawing up and keeping legal documents in compliance with accounting standards; manage your stay at the hotel; racking your consumption (telephone, bar, payTV, etc.); room access management; internal management of lists of guests who have behaved inappropriately during their stay at the hotel (aggression and incivility, non-compliance with the hotel contract, non-compliance with security rules, theft, etc.)

6. Conditions of access to your personal data by third parties
